FTA Seeking Public Comment on Changes to Third-Party Contracting Guidance

FTA has published a Federal Register Notice seeking public comments on Proposed Third Party Contracting Guidance by December 24th.  The guidance governs how grant recipients award and administer contracts to third-party subcontractors or vendors. This updated circular would replace the current circular, which has not been revised since 2013. Provide comments [docket # FTA-2024—0015] at the federal rulemaking portal and follow the instructions. 

The update provides new, non-binding guidance, including:  

  • specifying how the circular applies to different entities, including states, tribes, non-state recipients, and third-party contractors, and update guidance on recipient responsibilities; 
  • And, as contracts increasingly involve data collection, address data collection, ownership, and usage. 

Throughout the circular, revisions are proposed that would clarify or reorganize sections for improved readability, without substantively altering guidance from the current circular.
